Sean Shannon presents paper at legal studies conference

Dr. Sean Shannon ’89, a Lecturer of Law in the School of Economics and Business, presented a paper, “An Assessment of Justice Antonin Scalia’s Role in the Use of Legislative History in Statutory Interpretation and Judicial Decision Making,” at the Western Academy of Legal Studies in Business’ 2018 Annual Conference in Monterey, California, on March 10.
 
The paper assesses the impact of Justice Scalia’s efforts over almost thirty years to limit the use of legislative history and other secondary sources in statutory interpretation in judicial decision making and evaluates countervailing and alternative approaches to statutory interpretation. Statutory interpretation, particularly in the area of business law, is a fundamental tool to understanding legislative intent, and the paper contributes to understanding trends on the United States Supreme Court and the impact on business law.
